In Ireland, a country where Catholic influence no doubt has sway over the hearts and minds of many constituents, it has likely also influenced legislation, leading to a constitutional ban on abortion. The ban, in keeping with the Catholic anti-abortion stance, has been ruled unconstitutional by the European Court of Human Rights, a ruling that came with a harsh condemnation of the country’s government for failing to take action on this hot-button issue. The court, based in Strasbourg, France also decided in 2005 that women fighting cancer should be permitted to have an abortion in Ireland, rather than going to England for the procedure.

While that has put pressure on Ireland to move on the issue, the country has not passed a law to allow pregnancy termination in cases where a woman’s life is at risk. This despite a 1992 by the Irish Supreme Court that ruled that Ireland should provide abortions in instances when a woman’s life is in danger. Irish doctors, afraid of being prosecuted for breaking a law that semi-exists, have largely refused to perform abortions under any circumstances, forcing most women to travel to England to have the procedure.

The 11-6 verdict by the Strasbourg judges came with a note about Ireland’s failure to act, saying it "Has resulted in a striking discordance between the theoretical right to a lawful abortion in Ireland on grounds of a relevant risk to a woman’s life, and the reality of its practical implementation." Ireland Health Minister Mary Harney noted that she had confidence that a new law would be forthcoming, adding, "Clearly we need to legislate, there’s no doubt about that. But I don’t think we have the capacity to bring forward proposals in a matter of weeks."
